CHAPTER 13
Chapter 13 is a case where a “plan” is developed and filed with the bankruptcy court to pay back all, or at least some portion of your debts.
USES:Used many times to Stop IRS levies / garnishments at 0% interest.
Stop foreclosures & work out a plan to pay back arrears on mortgage payments.
Sometimes the “Means Test” will dictate some portion of your debt must be paid back through a Plan. As an example … you may be required to pay back only 10% of your unsecured debt at 0% interest, while 90% of the discharageable debt is legally eliminated when your case receives it’s Discharge Order.
